Terms of Service

dink helps two people organise money together: budgets, savings goals, shared expenses and a record of who owes whom. That is all it is.

dink is not a bank, credit union, lender, broker, money transmitter, or payment processor. It does not hold, store, transfer, or have access to your funds. It does not connect to your bank and never asks for banking credentials. It does not provide financial, investment, tax, accounting or legal advice, and nothing in the Services is a recommendation to take any financial action.

Everything in the App is information you enter yourself. We cannot verify it, and the totals, balances, budgets, scores and projections the App shows are calculations performed on your own inputs. They may be wrong if your inputs are wrong or incomplete. Do not rely on them as a record of your actual finances — your bank’s own statements are the authority on that.

Marking something as “settled”, recording an IOU, or resolving a duel records what you and your partner have agreed between yourselves. It creates no legally enforceable debt, transfers no money, and we are not a party to it.

You must be at least 18 years old and able to form a binding contract to use the Services. By using them you represent that you are.

You need an account to use the App. You agree to provide accurate information, to keep your password confidential, and to be responsible for everything that happens under your account. Tell us promptly at hello@letsdink.co if you believe your account has been accessed without your permission.

You can delete your account at any time from Settings in the App. Deletion is permanent and removes your data as described in our Privacy Policy.

dink is built for two people. When you pair with a partner using an invite code, you create a shared space, and your partner can see everything you put into it— shared transactions, splits, IOUs, duels, shared budgets and goals, the shared calendar, the grocery list, and joint balances. Only share what you are comfortable with them seeing. Items you keep personal rather than shared are not shown to them.

You are responsible for who you give your invite code to. Anyone holding a valid, unused code can join your space and will then see the shared information in it. Reset your code from Settings if you think it has gone somewhere it should not have.

Either partner can leave the couple at any time from Settings. When you leave, your personal data moves with you and the shared space and its shared data remain with your partner, because it belongs to both of you. We cannot arbitrate disputes between partners about shared data, money owed, or who is entitled to what. dink is a record of what two people told it; it is not evidence, and it is not a referee.

You may optionally connect with other couples. Doing so shares participation information — a display name, streaks, and counts of things completed — and never any financial amounts. You choose whether to connect, and you can remove or block another couple at any time from their profile.

There is zero tolerance for objectionable content or abusive behaviour. You agree not to use any name, text or other content in the Services that is unlawful, harassing, abusive, threatening, hateful, defamatory, obscene, sexually explicit, or that impersonates another person. You agree not to use the Services to harass, stalk, intimidate or monitor another person without their knowledge and consent.

You can block another couple from inside the App, which ends all sharing between you in both directions and prevents further contact. You can report content or behaviour to us at hello@letsdink.co. We review reports and act on them — which may include removing content and terminating the account responsible — and we aim to do so within 24 hours of a report.

Content created by other users is theirs, not ours. We do not endorse it and are not responsible for it.

You agree not to:

• Disrupt, attack, overload or attempt to gain unauthorised access to the Services or anyone else’s account or data.
• Access the Services other than through the interfaces we provide, including by scripting, scraping, or interacting with our backend directly.
• Attempt to guess, enumerate or brute-force invite codes or circle codes.
• Falsify the participation statistics the App publishes, or otherwise manipulate rankings.
• Reverse engineer, decompile, or attempt to derive the source code of the App, except where that restriction is prohibited by law.
• Use the Services for anything unlawful, or in breach of any applicable sanctions or export laws.
• Manipulate the referral programme, including with fake or automated signups.

What you enter in the App is yours. You keep ownership of it. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit and display it solely to operate and provide the Services to you and, where you have chosen to share it, to your partner and the couples in your circle. That licence ends when you delete the content or your account, except for copies held in routine backups for a limited period.

If you submit a feature request or other feedback, you grant us permission to use it without restriction or obligation to you. Do not submit anything you do not have the right to share.

When you join the waitlist you agree to receive email updates about dink, and can unsubscribe at any time. You are responsible for providing an accurate email address you are authorised to use.

Our referral programme may offer rewards, such as free months, when people sign up through your link. Rewards are promotional and offered at our discretion. We may change or end the programme and adjust reward terms at any time. Attempting to game it — fake or automated signups, for example — may result in forfeiture of rewards and termination of your account.

The App is currently free to use. If we introduce paid features or subscriptions, we will tell you the price and terms before you are charged, and you will never be charged without agreeing first. Any purchase made through the App Store is processed by Apple under Apple’s terms, and refunds for those purchases are handled by Apple according to their policies.

We may change, suspend or discontinue any part of the Services at any time. We will give reasonable notice of material changes where we can. We may also modify or remove features, and we do not guarantee that any particular feature will continue to exist.

We may suspend or terminate your access if you breach these Terms, if your use puts other users or the Services at risk, or if we are required to by law. Where it is appropriate and lawful to do so, we will tell you why. You may stop using the Services and delete your account at any time.

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, error-free, or that any calculation, total or figure they display will be accurate or complete.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

To the fullest extent permitted by law, dink and its operators will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or financial loss of any kind, arising out of or relating to your use of the Services — including any decision you make in reliance on information the Services displayed.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars ($50).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including for death or personal injury caused by negligence, or for fraud.

You agree to indemnify and hold harmless dink and its operators from any claim, demand, loss or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or content you submit.

These terms apply if you obtained the App from the Apple App Store, and Apple requires that we set them out:

• These Terms are between you and dink only, not with Apple. Apple is not responsible for the App or its content.
• We grant you a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide any maintenance or support for the App. Support requests go to hello@letsdink.co.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever for the App.
• dink, not Apple, is responsible for addressing any claim relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• dink, not Apple, is responsible for investigating and resolving any third-party claim that the App infringes that party’s intellectual property rights.
• You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict of law rules, and you and we agree to the exclusive jurisdiction of the state and federal courts located there. If you are a consumer resident in the UK, EU or elsewhere, this does not deprive you of the protection of mandatory consumer laws of your country of residence, or of the right to bring proceedings there.

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services.

We may update these Terms as dink develops. When we do we will revise the “last updated” date above, and for material changes we will give notice by email or in the App before they take effect. Continued use after changes take effect means you accept the updated Terms.
